TERMS & CONDITIONS OF RENTAL

These conditions set out the basis upon which the owners of the villa referred to as Casa Puig Ventos (Address: Mimosas, 145, Puig Ventos, Vidreres, Spain) accept rental bookings. You should read these conditions prior to booking. Contract If you make a booking with us, a binding contract will come into existence when we receive the deposit mentioned in (2) below. Your contract will be governed by English law and will be subject to the jurisdiction of the courts of England and Wales. Or, if you live in Northern Ireland or Scotland by their courts as appropriate. In all cases, the lead member of the party must be over 18 and accepts these booking conditions on behalf of all persons named on the booking, and agrees to keep all members of the party informed of all matters relating to the holiday. Payment When you wish to confirm a booking you must pay a deposit of 10% of the price of the holiday. If you book a holiday within 6 weeks of departure the full amount is due at the time of booking. The balance of your holiday cost is due not less than 28 days before departure. If all payments due are not paid in full and on time, we reserve the right to treat your holiday as cancelled by you and retain any deposits held. In addition to the balance of the holiday you are required to pay a bond of £200 to cover damage caused to Casa Puig Ventos. This will normally be returned within 14 days of the end of your holiday but in the event of damage exceeding the £200 bond held by the owners you shall pay the amount of the excess within 14 days of written demand. Price Guarantee The price of the holiday is not subject to surcharge. We reserve the right to change any of the prices, services or other particulars contained in our advertising material at any time before we enter into contract with you. If there is any change, we will notify you before we enter into such contract. Cleaning The villa is cleaned before and after each booking. If a booking exceeds 7 days it will be additionally be cleaned every seventh day. Extra cleaning may be requested but there is an additional charge for this service that must be paid at the time or will be deducted from the bond mentioned in (2) above. If the property is left in an unreasonable state at the end of the booking the cost of extra cleaning will also be deducted from the bond. Holiday Insurance You are strongly recommended to take out adequate insurance for all members of your party as we do not provide insurance as part of this booking and it is your responsibility to ensure that the insurance cover you purchase is adequate for your particular needs. Cancellation by You If you are compelled to cancel your holiday in full or part, you should inform us by telephone, and then immediately confirm your cancellation in writing. You remain responsible for the total cancellation charges of the booking and all outstanding balances must be paid in full. A cancellation can only be accepted in writing from the lead member of the party. The cancellation will be effective from the date the letter is received. In the event of a cancellation of any part of the booking, the following cancellation charges will be payable, which are based on the expenses and losses suffered by us as a result of cancellations. The charges are as follows: If notification is received more than 28 days before rental commencement the cancellation fee will be limited to the deposit. If however notification is 28 days or less before rental commencement the cancellation charge will be 100% of the rental for that period.

Amendments by You If you wish to amend your booking once it has been confirmed, we will always do our best to satisfy your requirements. However, changes to your holiday property will be treated as a cancellation by you and the cancellation charges in Condition 6 will be payable. Transfers of Bookings You may change your booking up to 28 days before departure by transferring it to another person if you are unavoidably prevented from travelling, and the transferee meets any conditions that apply to your booking. Cancellation by us In exceptional circumstances it may be necessary to cancel a holiday and we reserve the right to do so. However, we will endeavour not to cancel your holiday less than 28 days prior to departure unless you fail to make payment in full and on time or we are forced to do so as a result of circumstances beyond our control. If we have to cancel for a reason other than your default in payment, we will provide a full refund of all monies you have paid to us. In addition we will pay compensation as set out in Condition 11, subject to the following exception. Compensation will not be payable and no liability beyond offering the above mentioned choices can be accepted, where we are forced to cancel as a result of unusual and unforeseeable circumstances beyond our control, the consequences of which we could not have avoided even with all due care. Amendments by us The arrangements in our advertising material are planned many months in advance but it is, unfortunately, still possible that it may become necessary to make changes to your holiday arrangements, and we must therefore reserve the right to make such changes at any time. In the majority of cases, such changes are very minor and will not affect the enjoyment of your holiday. If a significant change becomes necessary we will inform you as soon as it is reasonably possible before your departure, if there is time to do so. In these circumstances we will give you the option of either: a) accepting the changed arrangements, b) cancelling your holiday with a full refund of payments made to us. Compensation Payments Compensation is paid as a percentage of the total holiday price and is based upon the period before the scheduled booking date when a significant change or cancellation is notified to you. Where a cancellation or major change is made as a result of force majeure we cannot pay any expenses or costs you incur as a result. Minor changes are not eligible for compensation and do not entitle you to cancel or take an alternative holiday without paying our normal charges. Compensation scale - More than 60 days: 5%, 43-60 days: 7.5%, 29-42 days: 10%, 1-28 days: 12.5%, 1-14 days: 15%. Your Responsibilities You are responsible for: oTaking all reasonable care of the property during your rental; oLeaving the property in a clean and tidy condition; and oAny damage to the property, its contents or to any Third Party visiting the property, which is caused by you, a member of your party or any person you invite to the property.

Party Size Owners reserve the right to refuse admittance should the maximum occupancy be exceeded. We do not allow tents or caravans/motor homes in the grounds. Complaints We do not wish to have dissatisfied clients and we consider it part of the contract to be given the opportunity to put right any grievances you may have whilst at the property. In the unlikely event you are dissatisfied, you must contact the local agent (contact details will be provided when the keys are handed over) at the time that the cause for complaint arises. Accordingly, in any situation in which you did not make a complaint or claim in accordance with this condition, and, had you done so, you could have mitigated your loss, we regret that we cannot accept any liability for such. complaint or claim. We cannot be held responsible for unforeseen construction work in the vicinity of the rental property that is totally beyond control of the property owner. We have no power to stop construction work and, as such, cannot be held liable. Where any reference is made to local public services, these are intended for the clients’ convenience and we are unable to accept responsibility for the non-availability of these public services. All distances mentioned are approximate and driving times are a guide and may vary subject to road conditions and volume of traffic. Safety Standards It is the requirements and standards of the country in which any services make up your holiday that apply to those services, and not those of the UK. As a general rule, these requirements and standards will not be the same as the UK and they will sometimes be lower. As with all swimming pools without lifeguards, children/non-swimmers need close supervision and the area around the pool can become slippery. Customers should use caution when using the swimming pool.
